terms and conditions set forth below.
Content: All services provided
by eDelta.net may be used for lawful purposes only.
Transmission, storage, or presentation of any information, data
or material in violation of any United States Federal, State or
City law is prohibited. This includes, but is not limited to:
copyrighted material, material we judge to be threatening to our
network or obscene, or material protected by trade secrets and
other statutes. eDelta.net is not responsible for
any claims resulting from the use of our service. This is also
true for sites that promote any illegal activity or content that
may be damaging to eDelta.net servers or any other
server on the internet. Links to such materials are prohibited.
eDelta.net servers restrict such files as Adult
sites, pirated software, hacker programs/archives, MP3, and Warez sites or anything else that is illegal according to
federal law.
Uptime Guarantee: If your
website is not up for at lease 99% of the time during a
one month period (excluding hardware upgrades), you will be
credited with a month of hosting. If you have a
yearly billing plan, we will add an additional month of hosting to your
contract at no cost.
Commercial Advertising: Email
(SPAM): Spamming, or the sending of unsolicited email, from a
eDelta.net server or using an email address that is
maintained by eDelta.net is STRICTLY prohibited and
will qualify your site for immediate deactivation with no
refund.
Server Abuse: Any attempts to
undermine or cause harm to any eDelta.net server or
customer of eDelta.net is strictly prohibited. Delta
eSolutions, Inc. holds no responsibility for the use of our
clients' accounts. Any account that abuses the server will be
instantly de-activated with no refund and will be charged the
cost of damage on the servers.
Traffic Usage: All account
plans come with a predetermined amount of traffic allowance. We
monitor all accounts and will request an account upgrade if you exceed
your traffic allowance for more than one month.
Back-ups: eDelta.net,
Inc. performs weekly backups on all of our servers to ensure
critical files are not lost. Our server software will create backups for
your sites which you may download on your own. We do not restore a file any user has accidentally deleted or
modified. The back-up restoration is for emergency procedures
only. You are advised to backup all of your own files to your
local drive. eDelta.net is NOT responsible for lost
data, time, income or any other resource due to faulty backups
or nonexistent back-ups.
Loss: eDelta.net is not responsible for any business loss or any
times of commercial/non-commercial activity.
Billing Refunds: Users
are entitled to a refund of their monthly hosting fees if the hosting account has been active
less than 30 days. If the hosting account exceeds that period time, no
money will be returned. If a user has paid for a yearly
hosting plan, we will refund the remaining amount of the plan after
deducting normal monthly fees for past months.
Billing Questions: ALL questions and
correspondence regarding billing must be made in writing (fax, mail, or
email). This is to maintain an accurate record for billing and legal
purposes. We will be happy to explain any charge in person or over
the phone for existing clients. After such discussion, the client
is responsible to submit any disputes or concerns formally in writing
(fax, mail, or email).
Billing Options:
Those not opting for PayPal automatic deductions must pay yearly. The customer is responsible to
pay monthly hosting fees each month via a PayPal subscription.
Neither invoices nor reminders will be sent except at our discretion.
Billing Late Fees:
A $5 fee will apply to all monthly hosting charges more than 30 days
overdue. A 12% surcharge will be added to all service fees (including
but not limited to, web design, marketing, and domain registration) more
than 30 days over due.
Suspension of Accounts: Accounts more than 45 days overdue
are subject to suspension until payment has been received, or a written
payment agreement has been agreed upon by eDelta.net and the client.
eDelta.net reserves the right to suspend any web site for non-payment of
any fee or service. A $99.95 reconnection fee applies to all
un-suspended accounts.
Donation of Services: Occasionally we may donate all or part
of our services to non-profits. Unless a user is provided with a
written notification, all normal fees apply to all services provided.
Free Domain Registration:
We offer free domain registrations for Standard and Specialty Hosting
Plans. To receive the free registration, the domain must be
registered by or transferred to eDelta.net If you choose to use
another company to register your domain, you must pay domain registration
fees to that company. eDelta.net is not responsible for your failure
to renew domains registered through other companies.
To protect ourselves from
customers opening an account just to receive a free year of
domain registration and then canceling etc., or not paying for other
services, the domain will be
registered under our name, eDelta.net. In the
event a customer does not pay their balance in full,
eDelta.net reserves the right to retain ownership of all domain(s)
at anytime.
Cancellation: Cancellation can
be made via email to
sales@edelta.net. Although no notice is
required, and there is no cancellation fee, all fees paid for
service up to the notice of cancellation are non-refundable. If
cancellation is made within the first 30 days of service all
hosting fees will be refunded. This does not include fees for
domain registration.
Upon cancellation, either by
eDelta.net or the client, all fees must be paid in full. We reserve
the right to block any transfer of service until each account is paid in
full.
Indemnification: Customer
agrees that it shall defend, indemnify, save and hold eDelta.net. harmless from any and all demands, liabilities,
losses, costs and claims, including reasonable legal fees
asserted against eDelta.net or its Customers, that may
arise or result from any Service provided or performed or agreed
to be performed or any product sold by Customer, its agents,
employees or assigns. Customer agrees to defend, indemnify and
hold harmless eDelta.net against liabilities arising
out of; (1) any injury to person or property caused by any
products sold or otherwise distributed in connection with Delta
eSolutions, Inc.'s server; (2) any material supplied by Customer
infringing or allegedly infringing on the proprietary rights of
a third party; (3) copyright infringement and (4) any defective
products sold to customer from eDelta.net's server.
This paragraph shall remain in effect for three years after the
termination of this Contract.
Refusal of Service: We reserve
the right to refuse, cancel, or suspend service at our sole
discretion.
These terms may be modified at
any time and without notice. All users previous and new are
always subject to the newest terms posted here (www.eDelta.net) at all times.
Those not signing up online are still subject to these terms.
Clicking on "I agree" below is not necessary to be subject to
these terms. Acceptance
of our services online, by mail, phone, in person, or by any other means constitutes an agreement to these terms.
Now with all the legal stuff
behind us, let's setup your account! First we'll need to collect
your chosen account information, then we'll proceed to billing.
After you order your account, you can check the status of your
order at any time. At this time we look activate accounts manually for verification purposes. To prevent abuse of our servers
by Spammers or terrorists, we no longer automatically set up accounts. |
